Unhappy Buyer Beware

Be careful when purchasing a new bike in California. I just purchased a 2002 GSX-R1000 from a dealer in Hollywood 2 months ago. When I got the first payment statement, it's terms did not at all match the sales contract. I signed this contract in good faith. I contacted the dealership (4 times- still waiting for a return call), the finance company, the BBB, Consumer Affairs etc. Apparently the only way to resolve this is to go to small claims court. This is the advice I got from all of the agencies. All I wanted was for the contract terms to be honored. Anybody have any other advice?????

Something is not right, If I were you I would talk to one of those free consultation lawyers. Go down and see the manager of that store, try to find out what is going on. Read all your fine print that you signed see if their is somthing you or the dealer missed. Good Luck.

Assuming you financed through the dealer, take your sales contract, payment statement, and any other documents you have back there and speak to their finance manager (or sales manager if they don't have a finance manager). Either someone made a mistake, misunderstood something, or is trying to pull something (not very likely). Your quickest path to resolution is starting with the people at the dealer. Anyone else will ask you what you tried to do to resolve the issue anyway.

I did call and visit the dalership to no avail. Now that BBB and Consumer Affairs is involved they are responding and will correct the issue. My guess was that laziness was the culprit. Nobody could be bothered correcting the issue until gov't agencies got involved.

Just out of curiosity, what "terms" did not match and between what document and your payment statement? Glad to hear that it's being resolved.

The terms that did not match were the interest rate and duration of the loan. The length of the loan being shorter does not bother me because I was going to accelerate the payments anyhow. When all is said and done the dealership is going to write a check for the difference in the interest rate.

Yeah, interest rate and duration are kind of key terms. Glad they are going to make it right. Make sure that the check they write you fully covers the interest rate difference for the whole duration of the loan. Interesting that making the duration shorter makes the check they owe you smaller.
