Do Not Order From Bike Decals Inc!!!

This post is intended on informing the members of this web site of the type of business practices of Bike Decals Inc aka http://sportbikedecals.com/

(Long Post, Please Forgive Me)

Here is the deals is, I ordered $95.58 worth of decals from them for my 600RR and still have not received my order.

Here is what happened: On March 1st I orders the decals and I received a preorder confirmation email. On the 3rd I received an email stating my order had been confirmed and they withdrew the funds from my account. On the 10th I started to wonder why I hadnít received an email stating my order had been shipped, so I send them an email asking for the status of my order. I waited five days, no reply to that email, by this time it was the 15th and according to their shipping ordering policy I should have my order no later than 14 days after the order was placed. Once again I sent them an email asking for my orderís status, but this time I was right to the point and quoted their shipping policy. Later that night I received this email:

Hello. Repsol decals on back order.
We got them today.
Your order will go out by Wednesday

Sorry for the delay.

I was a little pissed that they didnít inform me about the back order before withdrawing the funds from my card, but hell I though my order was on itís way to me. Well eight days went by and on package. Once again I sent them an email, here is the email I sent:

It has been one week (7 days) since you stated my order was shipping out on Wednesday March 17th 2004. I have not received my order and I can not see it taking more than seven days to get a package from Florida to Maryland. If I do not have my order at my home by Monday March 29th, 2004 I expect a full refund ($95.58) no later than noon on Monday March 29th, 2004.

I do apologize for this email if my order did ship out on Wednesday March 17th 2004.

And here is their reply:

Well the Monday (March 29th) has come and gone and still my order has not been delivered to me. Last night I sent out this email:

If I am not refunded the full amount for this order by 4:00 PM tomorrow (Tuesday March 30th, 2004) I will be forced to contact Free Merchant.com, the Better Business Bureau, and seek legal counsel.

As of now (4:30 PM on March 30th) My order has not been delivered and I have not received a refund for my order. Looks like Iím taking a trip to Tampa to sue these ass-holes, o-well the wife has been wanting to go on a trip.

did you charge with a credit card??? if you did, call the 800 number on the back, and tell them your story, you will get your $$$ back ive done it a bunch of tiomes,,, hell i got a full refund on a pager and 6 months of service because the service was shitty, and i used that Mfer...

no prob, let us know how it went!!! i ve never had a problem getting $$$ back when i go through my credit card company... NEVER... just some legwork, tell a few people, fill out a form send it in... but nowhere near small claims court...

blank is right on. Technically, though, you need to report the incident before 30 days; that's a legal setting, not a courtesy period. And, technically, its fraudulent for any entity to charge your credit card without delivering the material, or having shipped the material (the exceptions to that rule are car down payments and hotels).

So, right now they're in breach of their Visa/Mastercard agreement, assuming you did it that way. And, they're in legal trouble because of the fraud that was committed.

Why do I know these things? Because I'm the Ecommerce specialist where I work, and have been for quite some time (think years).

Your credit card company will set you up, and you might consider these additional measures:
1) Report to Better Business Bureau
2) Report to your state attorney general
3) Report to their state attorney general
4) Posting, as you have, on as many Bulletin Boards as you can find.

EDIT: I nearly forgot to mention that if you're special ordering, the dealer can require a deposit on the product, but must have evidence the product was ordered by them before the charge was made to your account. And they must honor, in full, any request for refund in the case of backorders. Can't tell if you fall into any of these categories.

You should send them an email with the link to this post and see what they have to say about hitting your card before shipping. That's totally illegal.

agreed w/ above. At a minimum, simply contest the charge on your card...they will go after them.

The extra stuff noted above is to help/warn future "victims".

It is not illegal to take payment via credit card as a deposit. I do it all the time to make sure people don't back out of special order stuff (ie--change mind after I make product).

Calling your credit card is the thing to do.
